Terms & Conditions
1.1 The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”You”) with Weekday through H & M Hennes & Mauritz GBC AB, hereinafter referred to as “Weekday”, ”Us ” or ”We”, at the website or mobile website weekdaystudiomade.bigcartel.com (jointly referred to as ”Studio Made”).
1.2 By using Studio Made and/or placing an order, You agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure You have read and understood the Terms before placing Your order.
1.3 Only persons of legal age, 18 years or older, who are not under guardianship, and are not acting in capacity as a company, with a physical address in one of the countries that Weekday provides deliveries to in the European Union and United Kingdom, excluding Guadeloupe, Martinique, Guayana , Réunion , New Caledonia, French Polynesia, Wallis and Futuna, Mayotte, Saint-Martin, Saint Barthélémy, Saint-Pierre and Miquelon, French Southern and Antarctic Lands, Campione d'Italia, Livigno, San Marino, Vatican City, Madeira, Azores, Canary Islands, Ceuta, Melilla and mail forwarding companies, can place an order. Weekday and its distributor reserves the right to restrict different areas for delivery during certain times of the year, e.g. due to adverse weather conditions that may hinder delivery.
1.4 The inclusion of any products or services on Studio Made at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.
1.5 We reserve the right to amend these Terms from time to time without prior notice. The version of the Terms that will apply to Your order will be those on Studio Made at the time You place your order.
1.6 Weekday want to provide the best possible online experience. To make this possible We need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the Studio Made site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these Terms & Conditions.
2. Prices and delivery charges
2.1 The prices displayed at the Studio Made site include the statutory Value Added Tax but does not include a delivery charge.
2.2 The price does not include import taxes or custom duties. Import taxes/custom duties will be charged by Your carrier at delivery and We do not compensate these charges.
2.3 If the value of Your order exceeds the toll free limit in your market extra fees will be applied upon delivery.
2.4 Please check with Your local Customs Office for more information.
2.5 The delivery charge for each order will be the same, regardless of the size or weight of Your order. The cost for each delivery method is clearly indicated during the checkout process. If We are unable to deliver Your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.
3. Ordering/conclusion of contract
3.1 The ordering option available to You is via Studio Made.
3.2 Once You have placed your order, if You have supplied us with your email address, You will receive an email confirmation. If for any reason We are unable to fulfill Your order, We will let You know at the earliest opportunity. If We have already received payment for such order, We will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary We will notify You and ask You to contact customer service on email@example.com and a representative will settle the refund.
4.1 Weekday exercises the utmost diligence in accepting and processing orders and will endeavor to deliver Your order in accordance with your selected delivery option.
4.2 Before placing Your order, You will be informed of the expected delivery details 3-5 days. Once You have placed Your order You will receive an email confirmation. When your order is processed, we will send a shipping confirmation. After that, We aim to deliver your parcel between 1-2 working days.
5. Right of Withdrawal
5.1 You may return Your order from the date You place the order until 14 days after receipt of the ordered items. If You have been charged for the items, You will receive a refund which will include our standard delivery costs, 50 SEK. Should You choose to keep certain items and only partially cancel Your order, the delivery cost will not be refunded.
5.2 If You wish to return your order, please provide Us with notice in writing by contacting Us at firstname.lastname@example.org; or by filling in and submitting the standard form issued by your local Consumer Rights Authority; and return the item(s) to Us within the 14 day period set forth in section 5.1 above. We will provide a refund attempting to use the same method used to make the payment as soon as possible and at the latest within 14 days of receiving Your notice of cancellation, provided We have received the items or evidence of You having sent back the items. Another payment method may be used for the refund, provided that You consent to such change; in any case this will not generate any additional charges.
5.3 Weekday guarantees a full refund for any returned items, provided that all items are returned in the same condition they were in upon Your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact.
6. Faulty goods
If the item You receive is faulty, please notify Weekday at Your earliest convenience at email@example.com. Weekday will provide You with more information. If Weekday deems the item faulty You will be provided a full refund of the price fo the garment. The refund will be issued using the same method You used for the original purchase. Weekday may use other methods of issuing the refund, granted that such methods does not entail extra costs for You.
7. Payment methods
7.1 You can pay for Your goods as set out below.
7.2 When paying by PayPal, Weekday and its service providers reserves the right to check the validity of the PayPal account and that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be debited on Your PayPal account. Weekday reserves the right to deny any purchase.
7.3 You are obliged to submit a correct e-mail address and to inform Weekday if Your e-mail address changes.
7.4 Please note that We are unable to accept gift cards and merchandise cards via Weekday as forms of payments on Studio Made.

8. Our Liability
8.1 Nothing in these Terms shall exclude or limit Weekday's liability with regard to any matter for which it would be unlawful for Us to limit or exclude our liability.
8.2 We do not seek to exclude liability for fraudulent misrepresentation by Us or our employees or agents. If We breach these Terms, We shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
8.3 Weekday is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, i.e. force majeure.
8.4 Our maximum liability to You for any loss or damage arising in connection with Your order on the Studio Made site shall be limited to the total price of Your order.
8.5 If You have a problem with a product that You have purchased from Studio Made, and were not able to settle the complaint with Weekday, then You can submit Your complaint to the EU’s online dispute resolution platform (the “ODR platform”). The ODR platform offers consumers and traders within the EU with the possibility to try and reach an out-of-court settlement for complaints arising from online purchases. This single entry point is designed to be a user-friendly and interactive website, available in all EU official languages and free of charge. Using the ODR platform the consumer and the trader can find a dispute resolution body and then go through the process of finding a solution to the consumer’s complaint. The ODR platform is available here: http://ec.europa.eu/odr.
We make all reasonable efforts to accurately display the attributes of our products, including composition and colors. The color You see will depend on Your computer system, and We cannot guarantee that Your computer will accurately display such colors.
If there are defects in the goods You have purchased, Weekday abides by all statutory guarantee regulations. If You have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let Us know by contacting our Customer Service at email@example.com.
Weekday reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
13. Ownership of rights
All intellectual property rights, such as trademarks and copyrights at the Studio Made site remain with H&M Hennes & Mauritz AB and its subsidiaries or licensors. Any use of Studio Made or its contents, including copying or storing such content in whole or part, other than for Your own personal, non-commercial use, is prohibited without the permission of Weekday.
